Welcome to Utang Na Load ("the Service," "the App," "we," "us," or "our"). By accessing or using this application, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Service.

1. Description of Service

Utang Na Load is a mobile-first progressive web application (PWA) that facilitates prepaid load lending ("Utang Load") for qualified subscribers of participating telecommunications networks in the Philippines. The Service assists users in checking eligibility, selecting available load packages, and initiating USSD-based transactions with their mobile network operator.

2. Eligibility

To use the Service, you must: (a) be at least eighteen (18) years of age or the age of majority in your jurisdiction; (b) be a subscriber of a participating Philippine telecommunications network; (c) have an active prepaid SIM registered under your name in compliance with Republic Act No. 11934 (SIM Registration Act); and (d) meet the eligibility criteria set by your network operator for load lending services.

3. User Obligations

You agree to: (a) provide accurate and truthful information, including your mobile phone number; (b) use the Service only for its intended purpose; (c) not attempt to circumvent eligibility checks or manipulate the system; (d) repay any borrowed load in accordance with the terms set by your network operator; and (e) comply with all applicable Philippine laws and regulations.

4. USSD Transactions

The Service facilitates USSD (Unstructured Supplementary Service Data) calls to your network operator. You acknowledge that: (a) USSD calls are processed by your telecommunications provider, not by us; (b) the success of any load lending transaction depends on your network operator's systems and your account eligibility; (c) we are not responsible for failed, delayed, or incorrect transactions processed by your network operator; and (d) standard USSD calls are toll-free but may be subject to your operator's policies.

5. SMS Communications

With your explicit consent, we may send you SMS messages for: (a) one-time password (OTP) verification; (b) transaction confirmations; (c) service reminders and notifications; and (d) promotional communications related to the Service. You may opt out of non-essential SMS communications at any time through the app settings. Standard messaging rates from your network operator may apply.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, and the overall design — are owned by or licensed to VoxP Technologies and are protected by Philippine intellectual property laws, including Republic Act No. 8293 (Intellectual Property Code of the Philippines).

7. Limitation of Liability

To the fullest extent permitted by Philippine law, we shall not be liable for: (a) any indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, data, or goodwill; (c) service interruptions or system failures; (d) actions or omissions of third-party telecommunications providers; or (e) any damages arising from your use or inability to use the Service. Our total liability shall not exceed the amount of the last load transaction facilitated through the Service.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the Service's availability, reliability, accuracy, or fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to: (a) violation of these Terms; (b) suspected fraudulent activity; (c) request by law enforcement or government agencies; or (d) discontinuation of the Service.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising from or in connection with these Terms shall be resolved through amicable settlement. If no settlement is reached within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Quezon City, Philippines.

11. Amendments

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the Service. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify you of material changes through the app or via SMS.
